Litigation Financing

The professional financing of court proceedings and arbitration proceedings has become increasingly important in Germany in recent years. We advise and represent national and international litigation financiers in all phases of financed projects: In the initiation phase, we examine the prospects of success of possible lawsuits. We also support litigation financiers in negotiations on the litigation financing agreement. We also support litigation financiers in the ongoing monitoring of financed projects, in particular to take due account of current developments in case law and legislative amendments (in recent years, primarily in the area of regulatory advice in connection with the assignment model). Disputes may arise from the litigation financing agreement even after the financed projects have been completed (especially in the distribution phase). In such cases, we represent litigation financiers in asserting or defending claims arising from the litigation financing agreements.

We also have extensive experience in having disputes in which we act as legal representatives financed by litigation financiers.
